Planning conditions
  1. Reason for Refusal of Planning Permission In accordance with paragraph (38) of the National Planning Policy Framework the Local Planning Authority has worked with the applicant in a positive and proactive manner to approve the proposed development. However, in this instance the proposal fails to accord with the Local Plan and the National Planning Policy Framework.
  2. 1. The proposed development would result in the loss of a three-bedroom C3 dwelling, at a time when Cannock Chase District Council is unable to demonstrate a five-year housing land supply, having a significant shortfall of 3.12 years. Paragraphs 61 and 78 of the National Planning Policy Framework emphasise the importance of significantly boosting the supply of homes and ensuring a sufficient amount and variety of land comes forward where it is needed. Policy CP7 of the Cannock Chase Local Plan (2014) also seeks to restore balance in the housing market by encouraging the provision of housing types including family-sized dwellings. The applicant has not provided sufficient evidence to demonstrate a local need for the proposed care home use within the District, and while reference is made to a national need, this does not outweigh the harm caused by the loss of a family dwelling. The proposal would therefore undermine the Council’s ability to meet its strategic housing requirements and is contrary to Paragraphs 61 and 78 of the NPPF and Policy CP7 of the Cannock Chase Local Plan 2014.
  3. 2. The proposed development, involving the change of use to a care home accommodating young individuals under 24-hour supervision, would result in a level of activity and intensity of use of the site which is materially different from that of a typical single-family dwelling. The use would introduce a transient character to the site, resulting in increased comings and goings, particularly during early morning and late evening hours. The applicant has failed to provide sufficient evidence or detailed mitigation measures to demonstrate that the proposed use would not result in significant disturbance for neighbouring occupiers. The lack of detailed mitigation measures to proactively prevent disturbance further undermines confidence in the suitability of the proposed use in this location. As such, the proposal would result in an unacceptable level of noise and disturbance, causing harm to the living conditions of neighbouring occupiers and would therefore be contrary to Policy CP3 of the Cannock Chase Local Plan 2014 and Paragraph 135 of the National Planning Policy Framework.
  4. 3. Evidence from Staffordshire Police confirms there have been significant police call outs and incidents involving the site, currently operating as supported living accommodation. The applicant has failed to provide sufficient mitigation measures to assure that these issues will not continue under the proposed C2 care home. Given the evidence of past incidents and the absence of robust safeguards, the Local Planning Authority is not satisfied that the proposed use would not result in further anti-social behaviour or crime, nor that the fear of crime would not continue to undermine community cohesion and the wellbeing of neighbouring occupiers. The proposal therefore fails to comply with Paragraphs 96 and 135 of the National Planning Policy Framework.
