The Applicant seeks to exercise the powers granted under Section 96A of the Town and Country Planning Act 1990 to make a non-material amendment application to alter Conditions 2 and 10 attached to the reserved matters approvals (LDC application reference: 23/01012/REMM and CCDC application reference: CH/23/0312, both determined on 19th July 2024). It is proposed to substitute in new plans and documents to change the surface water drainage design to direct all flows through the swale as an online device. This will allow it to act as both a storage and treatment device for all storm events and runoff and differs from that previously consented. It is proposed to reprofile the swale as set out in the accompanying Strategy and plan and remove the petrol interceptor. In consultation with the LLFA these changes are accepted and therefore it is agreed to amend the wording of Condition 2 and 10 to reflect the updated plan as follows: 10. “The development hereby approved shall be carried out in accordance with the approved Detailed Surface Water Drainage Strategy dated 12.7.2024 ref: 0049436-BHE-XX-XX-RP-C-0003 (Rev P06) and the Surface Water Drainage – Updates to Swale (Outfall B) ref: 0059278 (Rev 00) dated 07/08/2025 including the submitted Surface Water Drainage Design Note as amended 16 September 2025 . The scheme shall be fully implemented and subsequently maintained, in accordance with the timing/phasing arrangements embodied within the scheme, or within any other period as may subsequently be agreed, in writing, by the Local Planning Authority.”
