The application site is situated within the 15Km Zone of Influence for the Cannock Chase Special Area of Conservation (SAC). As such, the application fails to comply with Part 2A, Section 5B of The Town and Country Planning (Permission in Principle) (Amendment) Order 2017. The development would result in harm to the integrity of the Cannock Chase Special Area of Conservation through additional recreational pressure arising from the scheme through the construction of new dwellings. In the absence of bespoke mitigation or a signed Unilateral agreement to secure necessary financial mitigation towards the Cannock Chase Special Area of Conservation Delivery Implementation Plans (DIPs) the harm is unacceptable and the development fails to conform with Policy CP13 of the Cannock Chase Local Plan (2014), the Conservation of Habitats and Species Regulations 2017 and the National Planning Policy Framework.
The proposal represents inappropriate development in the Green Belt, contrary to Policies CP3 and CP14 of the Cannock Chase Local Plan (2014) and guidance given in the National Planning Policy Framework. The circumstances put forward do not justify overriding the presumption against inappropriate development in the Green Belt in this case.
Due to the site’s location within the Cannock Chase National Landscape, the scheme would introduce a tighter grain of development at the site, in contrary to the West Rugeley: Etchinghill and Springfields residential character and would have a detrimental effect on the character of the area contrary to the emphasis within Cannock Chase Local Plan Policy CP3 and CP14. The scheme would directly conflict with the emphasis within Local Plan Policy CP14 and the National Planning Policy Framework in terms of preserving rural openness and a sense of place.
Insufficient information has been provided to assess the impact of the proposal on trees protected under Tree Preservation Order 2008/30. As such, the scheme has not been demonstrated to comply with Policy CP3 and CP14 of the Cannock Chase Local Plan and the National Planning Policy Framework.
Reason for Refusal of Planning Permission In accordance with paragraph (38) of the National Planning Policy Framework the Local Planning Authority has worked with the applicant in a positive and proactive manner to approve the proposed development. However, in this instance the proposal fails to accord with the Local Plan and the National Planning Policy Framework.
