  1. STATUTORY BIODIVERSITY NET GAIN PLANNING CONDITION The effect of paragraph 13 of Schedule 7A to the Town and Country Planning Act 1990 is that, subject to some exemptions, every grant of planning permission in England is deemed to have been granted subject to the biodiversity gain condition that development may not begin unless: (a) a Biodiversity Gain Plan has been submitted to the planning authority, and (b) the planning authority has approved the plan. This objective is for development to deliver at least a 10% increase in biodiversity value relative to the pre-development biodiversity value of the onsite habitat. This increase can be achieved through onsite biodiversity gains, registered offsite biodiversity gains or statutory biodiversity credits, in that order of priority. Based on the information available this permission is considered to be one which WILL require the approval of a Biodiversity Gain Plan before development is begun because none of the statutory exemptions or transitional arrangements are considered to apply. There are statutory exemptions and transitional arrangements which mean that the biodiversity gain condition does not always apply. These can be found at Biodiversity net gain: exempt developments - GOV.UK (www.gov.uk). The planning authority, for the purposes of determining whether to approve a Biodiversity Gain Plan in respect of this permission is Cannock Chase Council. The Biodiversity Gain Plan should be submitted as an ‘application for approval of details reserved by condition following grant of planning permission’ via the Planning Portal. When applying to discharge the biodiversity gain condition the LPA requests that the applicant uses the standard national templates for a Biodiversity Gain Plan and a Habitat Management and Monitoring Plan. Submit a biodiversity gain plan - GOV.UK (www.gov.uk) The biodiversity gain condition cannot be removed or varied.
  2. Prior to the commencement of the development a scheme detailing the makes, models and locations of nesting features for swifts shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall include: a. A minimum of 20 artificial swift nests, provided as integrated swift boxes within the fabric of the multi-storey car park, unless the applicant submits robust evidence demonstrating that integrated provision is unfeasible. b. Where integrated boxes are demonstrated to be unfeasible, external swift boxes of an appropriate design and specification shall be installed instead. All nesting features shall be installed prior to first use in accordance with the approved scheme and retained for the lifetime of the development. Reason: To incorporate features into the development which support priority or threatened species in accordance with paragraph 187(d) of the NPPF.
  3. The development hereby permitted shall not commence until the following document has been submitted and approved in writing by, the Local Planning Authority: • Construction Surface Water Management Plan. The plans/documents shall evidence that adequate provision for surface water management, both in terms of runoff quantity (flows and volumes), as well as quality (pollution mitigation, including sedimentation). The approved details shall thereafter be adhered to throughout the construction period. Reason: To prevent flooding by ensuring the satisfactory storage and disposal of surface water from the site and to ensure lifetime maintenance of the system to prevent flooding issues.
  4. The development shall not commence until a Habitat Management and Monitoring Plan (the HMMP) prepared in accordance with the approved Biodiversity Gain Plan has been submitted to, and approved in writing by, the Local Planning Authority. The approved HMMP shall be strictly adhered to and implemented in full for its duration and shall contain the following: a. a non-technical summary; b. the roles and responsibilities of the people or organisation(s) delivering the HMMP; c. the planned habitat creation and/or enhancement works to achieve the biodiversity net gain in accordance with the approved Biodiversity Gain Plan; d. the timeframe for the start and end of the habitat creation and/or initial enhancement works for the purposes of defining the start of the 30 year management and monitoring period; e. the management measures to maintain habitat in accordance with the approved Biodiversity Gain Plan for a period of 30 years from the completion of the habitat creation and initial enhancement works; f. the monitoring methodology in respect of the created and/or enhanced habitat; g. the legal and funding mechanism(s) by which the long-term implementation of the plan will be secured by the developer; h. mechanisms of adaptive management to account for necessary changes in work schedule to achieve the required targets; i. a timetable for review of the management actions and monitoring; j. the procedure(s) in the form of a remediation and reinstatement methodology for addressing a failure to manage and maintain the full extent of habitat(s) to the specified condition(s) at any point in time over the period of the HMMP. The created and/or enhanced habitat specified in the latest approved HMMP shall be managed and maintained in accordance with the latest approved HMMP. Reason: To ensure the development delivers a biodiversity net gain on site in accordance with Schedule 7A of the Town and Country Planning Act 1990 and the Cannock Chase District Local Plan (2026).
  5. The development to which this permission relates must be begun not later than the expiration of three years beginning with the date on which this permission is granted. Reason: To comply with the requirements of Section 91 of the Town & Country Planning Act 1990.
  6.   8. The development hereby approved shall be carried out in accordance with the external materials specified on the approved plans unless otherwise agreed in writing by the Local Planning Authority. Reason: In the interests of visual amenity and to ensure compliance with Local Plan Policies SO2.2 and SO1.2 and the NPPF.
  9. The development hereby permitted shall not be brought into use until the servicing and parking areas have been provided in a bound and porous material in accordance with the submitted Drawing No. ACMSWZZDRARC10710 Rev P03 and shall thereafter be retained for the lifetime of the development Reason: In the interest of highway safety.
  10. Any tree, hedge or shrub planted as part of the approved landscape and planting scheme (or replacement tree/hedge) on the site, which dies or is lost through any cause during a period of 5 years from the date of first planting, shall be replaced in the next planting season with others of similar size and species, unless otherwise agreed in writing by the Local Planning Authority Reason: In the interests of visual amenity and to ensure compliance with Local Plan Policies SO2.2 and SO1.2 and the NPPF.
  11. Prior to commencement of the development hereby approved, the Tree Protection Measures shall be implemented in accordance with the details set out within the Arboricultural Assessment dated April 2025, produced by FPCR Environment and Design. Tree protection measures. Thereafter, the measures shall remain in place for the duration of the construction period Reason: The existing vegetation makes an important contribution to the visual amenity of the area, in accordance with Local Plan Policies SO2.2 and SO1.2 and the NPPF.
  12. Monitoring reports including biodiversity reconciliation calculations at years 2, 5, 10, 20 & 30 of the 30-year habitat management and monitoring period, shall be submitted to the Local Planning Authority in writing in accordance with the methodology specified in the latest approved Habitat Management and Monitoring Plan. Reason: To ensure the development delivers a biodiversity net gain on site in accordance with Schedule 7A of the Town and Country Planning Act 1990 and the Cannock Chase District Local Plan (2026).
  13. Prior to the first occupation or use of any part of the development, a completion report shall be submitted to, and approved in writing by, the local planning authority. The report must demonstrate, with supporting evidence, that the habitat creation and/or initial enhancement works identified in the latest approved HMMP have been completed for the purposes of defining the start of the 30-year habitat management and monitoring period. Reason: To ensure the development delivers a biodiversity net gain on site in accordance with Schedule 7A of the Town and Country Planning Act 1990 and the Cannock Chase District Local Plan 2026.
  14. The development hereby approved shall take place in full accordance with the lighting details set out within DWG ref Proposed External Lighting Lux Level Layout (Drawing), LTA, June 2025. The approved details shall be completed prior to first use. Reason: In the interests of visual amenity and to ensure compliance with Local Plan Policies SO2.2 and SO1.2 and the NPPF.
  15. Coal Authority The proposed development lies within a coal mining area which may contain unrecorded coal mining related hazards. If any coal mining feature is encountered during development, this should be reported immediately to the Coal Authority on 0345 762 6848.   17. In accordance with paragraph 38 of the National Planning Policy Framework the Local Planning Authority has worked with the applicant in a positive and proactive manner to approve the proposed development, which accords with the Local Plan and the National Planning Policy Framework.
  18.
