The applicant seeks to exercise the powers granted under Section 96A of the Town and Country Planning Act 1990 to make a non-material amendment application to alter Conditions 2 and 10 attached to the reserved matters approvals (LDC application reference: 23/01012/REMM and CCDC application reference: CH/23/0312, both determined on 19th July 2024). Condition 2 attached to both Councils' decision notices is a compliance condition that approves the plans and documents that the development should be carried out in accordance with. The LLFA raises no concerns about the proposed amendment to drainage routing as shown in the plans and therefore the addition of the following plans to Condition 2 is accepted: 0049436-BHE-XX-XX-DR-C-2532 (Revision P05) Proposed Surface Water Drainage – Sheet 3 0049436-BHE-XX-XX-DR-C-2547 (Revision P02) Proposed Combined Utilities – Sheet 3 0059278 Revision 03 – Amendments to Surface Water Drainage to Outfall C Condition 10 relates to compliance with the approved Detailed Surface Drainage Strategy and the wording is consistent between the LDC and CCDC decision notices. The applicant proposes to add the ‘Amendments to Surface Water Drainage to Outfall C’ Strategy to Condition 10. The Council raises no objections to this and in the face of support from the LLFA the wording to the condition is amended as follows: 10. “The development hereby approved shall be carried out in accordance with the approved Detailed Surface Water Drainage Strategy dated 12.7.2024 ref: 0049436-BHE-XX-XX-RP-C-0003 (Rev P06) and the Amendments to Surface Water Drainage to Outfall C Strategy ref: 0059278 (Rev 03) dated 17/06/2025. The scheme shall be fully implemented and subsequently maintained, in accordance with the timing/phasing arrangements embodied within the scheme, or within any other period as may subsequently be agreed, in writing, by the Local Planning Authority.”
