The application seeks a Non-material amendment to the wording of planning condition 8 associated with CH/23/0312. The amendment seeks to change the timescale stated within the condition from 'within three months' to 'prior to the first use of the development'. The applicant suggests this is due to the clearance works necessary to undertake the CCTV surveys of the outfalls which has not been able to take place to date for health and safety reasons due to recent wet weather events. It is further stated that by moving the compliance timescale to prior to the first use of the development, it is hoped that water levels fall to allow the clearance works and the CCTV surveys of the outfalls to be undertaken safely. A second timescale amendment is also proposed in terms of the remedial works required to repair the existing outfalls following the CCTV surveys. The applicant suggests based on when the CCTV surveys are expected to be undertaken, the completion of any remedial works, and the first use of the access road in September 2025 in reality, there is little opportunity to monitor the efficiency of the outfalls during the winter months when surface water levels are likely to be at their highest. To allow a full winter monitoring period to ensure that the outfalls are flowing and functioning correctly, it is proposed to allow a period for up to 12 months following the first use of the approved access road for any repair works to be complete. Officers have consulted with the County LLFA who originally requested the condition. The LLFA confirm no objections to the changes proposed and that they are accepting of the justification for the change in wording as put forward. Officers assess the proposed amendments to the timescales within Condition 8 does not give rise to any impacts which are material in the context of the scale and nature of the approved scheme. The changes remain in accordance with both CCDC and LDC’s respective Development Plans and the OPPs. As such, the amendments as put forward in line with the following wording are considered acceptable and ‘non-material’ in line with S.96a of the TCPA 1990 (as amended). Condition 8 is updated to read as follows: 8 “Prior to the first use of the development hereby approved, a CCTV survey of existing outfalls serving the development shall be undertaken and details of any remedials required to the existing drainage to ensure that surface water from the site is conveyed to the river without increasing flood risk to the site or others shall be submitted to and agreed in writing by the Local Planning Authority. Any works required to repair existing outfalls will be undertaken within 12 months from when the development is brought into use.”
