Planning conditions
  1. The development proposal is located directly adjacent to the boundary of no. 13 Chapel Street and, given the elevated position of the site together with the height of the proposed building, it would appear visually intrusive and overbearing to the amenity of the neighbouring occupiers. As such the proposal would cause harm to the amenity of residential occupiers, contrary to Local Plan Policy CP3 and paragraph 135(f) of the National Planning Policy Framework (2024).
  2. Reason for Refusal of Planning Permission In accordance with paragraph (38) of the National Planning Policy Framework the Local Planning Authority has worked with the applicant in a positive and proactive manner to approve the proposed development. However, in this instance the proposal fails to accord with the Local Plan and the National Planning Policy Framework.
  3. The application site backs onto Chapel Street and occupies a clearly visible position within its streetscape. The introduction of the proposed building, by reason if it position within the application site and its scale and mass would result in an incongruous and overbearing form of development that would be detrimental to the visual amenity of Chapel Street for its users and residents. As such the proposal conflicts with Local Plan Policy CP3 and paragraph 135(f) of the National Planning Policy Framework (2024).
