Planning conditions
  1. In accordance with paragraph 38 of the National Planning Policy Framework the Local Planning Authority has worked with the applicant in a positive and proactive manner to approve the proposed development, which accords with the Local Plan and the National Planning Policy Framework.
  2. Mining Remediation Authority The proposed development lies within an area that has been defined by the Mining Remediation Authority as containing coal mining features at surface or shallow depth. These features may include: mine entries (shafts and adits); shallow coal workings; geological features (fissures and break lines); mine gas and former surface mining sites. Although such features are seldom readily visible, they can often be present and problems can occur, particularly as a result of new development taking place. In areas where shallow coal seams are present caution should be taken when carrying out any on site burning or heat focused activities. If any future development has the potential to encounter coal seams which require excavating, for example excavation of building foundations, service trenches, development platforms, earthworks, non-coal mineral operations, an Incidental Coal Agreement will be required. Further information regarding Incidental Coal Agreements can be found here – www.gov.uk/government/publications/incidental-coal-agreement/guidance-notesfor-applicants-for-incidental-coal-agreements If any coal mining features are unexpectedly encountered during development, this should be reported immediately to the Mining Remediation Authority on 0800 288 4242. Further information is available on the Mining Remediation Authority website at: https://www.gov.uk/government/organisations/mining-remediation-authority
  3. The development to which this permission relates must be begun not later than the expiration of three years beginning with the date on which this permission is granted. Reason To comply with the requirements of Section 91 of the Town & Country Planning Act 1990.
  4. No materials shall be used for the external surfaces of the development other than those specified on the application. Reason In the interests of visual amenity and to ensure compliance with Local Plan Policies CP3, CP15, CP16, RTC3 (where applicable) and the NPPF.
  5. This permission expires on 7th February 2028 and on or before this date the use shall be discontinued and the buildings/works carried out removed and the site restored, so far as is reasonably possible to its condition immediately prior to the commencement of the development. Reason In order to enable the effect of the development on the surrounding area to be assessed and reviewed, if necessary and to ensure compliance with the Local Plan Policies CP3 - Chase Shaping - Design.
  6. The development hereby permitted shall be carried out in accordance with the following approved plans: • Location Plan - 245068 - MHA - XX - XX - DR - A - 01002 - S0 - P2 • Proposed Site Plan - 245068 - MHA - XX - XX - DR - A - 01001 - S0 - P2 • Proposed Plans and Elevation - 245068 - MHA - XX - XX - DR - A - 00001 - S0 - P2 Reason For the avoidance of doubt and in the interests of proper planning.
