Planning conditions
  1. In accordance with Paragraph 38 of the National Planning Policy Framework the Local Planning Authority has worked with the applicant in a positive and proactive manner to approve the proposed development, which accords with the Local Plan and the National Planning Policy Framework.
  2. The development hereby permitted shall be carried out in accordance with the following approved plans: Site Plan 2553-04 Existing & Proposed Plans & Elevations 2553-03 * Working Drawing Proposed Site Plan 2553.102 Rev A *as approved under planning permission CH/22/0071 Reason For the avoidance of doubt and in the interests of proper planning.
  3. The development to which this permission relates must be begun not later than 9-May-2025, the expiration of three years beginning with the date on which the original permission was granted. Reason To comply with the requirements of Section 91 of the Town & Country Planning Act 1990.
  4. The materials to be used for the external surfaces of the development shall be of the same type, colour and texture as those used on the existing building. Reason In the interests of visual amenity and to ensure compliance with Local Plan Policies CP3, CP15, CP16, RTC3 (where applicable) and the NPPF.
  5. The development hereby approved shall be completed in accordance with the details provided within the Phase 1 Assessment date June 2022 and the subsequent supporting statement dated 19th August 2022 by SP Associates and as demonstrated on Dwg.2553.102 A Working Drawing Proposed Site Plan as approved under planning permission CH/22/0071 which indicate the adoption of a 2000g DPM / reinforced gas membrane and underfloor venting in association with beam and block or per-cast concrete floor and finished with sealed joints. The development shall not be occupied until a validation/phase 3 report has been submitted to and approved in writing by this Department. A Validation Report is required to confirm that all remedial works have been completed and validated in accordance with the agreed Remediation Method Statement. Reason In order to enable the development to proceed in a safe environment and to protect the health and safety of its occupiers and to ensure compliance with Local Plan Policy CP3 and the NPPF.
  6. The development hereby approved shall be carried out in accordance with the details approved on Dwg.2553.102 A Working Drawing Proposed Site Plan as approved under planning permission CH/22/0071 which indicates the design and positioning for the tree protection fencing. Within the enclosed area known as the Tree Protection Zone, any development shall be carried out using hand dig only methods and development shall use the pile and beam foundation as detailed on the Site Plan. No storage of material, equipment or vehicles will be permitted within the Tree Protection zone. Service routes will not be permitted to cross the Tree Protection Zones unless written consent of the Local Planning Authority is obtained. The Tree Protection Zone will be maintained intact and the vegetation within maintained until the cessation of all construction works or until the Local Planning Authority gives written consent for variation. Reason The existing vegetation makes an important contribution to the visual amenity of the area. In accordance with Local Plan Policies CP3, CP12, CP14 and the NPPF.
  7. The proposed development lies within a coal mining area which may contain unrecorded coal mining related hazards. If any coal mining feature is encountered during development, this should be reported immediately to the Mining Remediation Authority on 0345 762 6846 or if a hazard is encountered on site call the emergency line 0800 288 4242.
