In accordance with paragraph 38 of the National Planning Policy Framework the Local Planning Authority has worked with the applicant in a positive and proactive manner to approve the proposed development, which accords with the Local Plan and the National Planning Policy Framework.
Mining Remediation Authority The proposed development lies within a coal mining area which may contain unrecorded coal mining related hazards. Rights of Way Public Footpath No. 9 Heath Hayes and Wimblebury Parish runs adjacent to the application site, immediately east of the site access. The granting of planning permission does not constitute authority for any interference with the public right of way and associated items - or its obstruction (temporary or permanent). This is the case both during the building stage or once the development is completed should the permission be granted. The term obstruction, in this context, applies to items such as gates or stiles which are regarded as licenced obstructions which must be sanctioned by the highways authority, and also to any vehicles parking on the right of way, including those associated with construction. NPPF 104. states that: Planning policies and decisions should protect and enhance public rights of way and access, including taking opportunities to provide better facilities for users, for example by adding links to existing rights of way networks including National Trails. Users of the path must be able to exercise their public rights safely and the path be reinstated if any damage to the surface occurs as a result of the proposed development. Any works that affect the surface of the footpath requires discussions with the County Council
Environmental Health a. The responsibility for safe development and secure occupancy of the site rests solely with the developer. b. The Local Planning Authority will determine the application based on the information submitted to it. Should a risk of harm remain following development, the developer may be held liable under Part 2A of the Environmental Protection Act 1990. c. Please note that Environmental Health comments relate to risks posed from land contamination to human health only; the Environment Agency and other agencies may have additional requirements.

The development to which this permission relates must be begun not later than the expiration of three years beginning with the date on which this permission is granted. Reason To comply with the requirements of Section 91 of the Town & Country Planning Act 1990.
No materials shall be used for the external surfaces of the development other than those specified on the application. Reason In the interests of visual amenity and to ensure compliance with Local Plan Policies CP3, CP15, CP16, RTC3 (where applicable) and the NPPF.
Prior to the commencement of the development hereby permitted and in accordance with the conclusions of the Phase One Environmental Assessment Report (IN24078 CL 001) dated January 2025: a) Where the assessment has identified the potential presence of land contamination, suitable site investigations shall be undertaken to determine the significance of that contamination. The site investigation findings, together with their interpretation, shall be submitted to the Local Planning Authority for approval. b) Where unacceptable risks from land contamination are confirmed, an appraisal of the remediation options, together with a detailed remediation strategy, shall be submitted to the Local Planning Authority for approval. c) The approved remediation strategy shall thereafter be implemented. A report verifying remediation shall be submitted to the Local Planning Authority for approval. The above requirements shall be undertaken in accordance with Environment Agency Land Contamination: Risk Management guidance. Reason To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems in accordance with the National Planning Policy Framework.
The development hereby permitted shall be carried out in accordance with the following approved plans: - Proposed Ground Floor Plan - 2651/04A - Proposed Site Location Plan - TQRQM24310180439529 - Proposed Side Elevations - 2651/06 - Proposed Front & Rear Elevations - 2651/05 - Proposed Block Plan (including Parking) - TQRQM24310180802693 Reason For the avoidance of doubt and in the interests of proper planning.
Notwithstanding the findings of the Phase One Environmental Assessment Report (IN24078 CL 001) dated January 2025, if, during the course of development, land contamination (which was not previously identified) is encountered, the developer shall report the fact to the Local Planning Authority as soon as is practicable. Details on how the additional land contamination is to be addressed shall be submitted to the Local Planning Authority for approval. Remediation shall thereafter be undertaken in accordance with the approved submission. If, on completion of development, no additional land contamination has been encountered, the developer shall confirm the same, in writing, to the Local Planning Authority. Reason To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems in accordance with the National Planning Policy Framework.
The development hereby approved shall not be used for any purposes other than those approved on Proposed Ground Floor Plan - 2651/04A. These uses are a staff kitchen, storeroom and staff WC associated with the commercial use of Gold Garage Ltd. Reason The impact on neighbouring property has been assessed based on the proposed use of the development, the Local Authority has not assessed any impact on the neighbouring properties for any other uses and therefore have not assessed compliance with the NPPF and Policy CP3.
