Planning conditions
  1. The development hereby permitted shall be carried out in accordance with the following approved plans: - Dwg No. JMD 642 10A Proposed site plan - Tree report and aboricultural impact assessment REF BALS033-20revC dated 3/5/22 - Tree protection Plan ref BALDS033-20 TPP RevC - Preliminary bat roost assessment and bird survey dated 15th February 2022 - Heritage Statement including Map regression Reason For the avoidance of doubt and in the interests of proper planning.
  2. The development to which this permission relates must be begun no later 27th May 2025. Reason To comply with the requirements of Section 91 of the Town & Country Planning Act 1990 and the date of the original planning consent CH/22/0060.
  3. No materials shall be used for the external surfaces of the development other than those specified on the application. Reason In the interests of visual amenity and to ensure compliance with Local Plan Policies CP3,CP15,CP16,RTC3 (where applicable) and the NPPF.
  4. No dwelling hereby approved shall be occupied until a scheme for the fitting of electric charging points for electric vehicles has been submitted to and approved in writing by the Local Planning Authority and the works comprising the approved scheme have been completed. The works shall thereafter be retained for the lifetime of the development unless otherwise approved in writing by the Local Planning Authority. Reason In the interests of improving air quality and combatting climate change in accordance with policy CP16 and the National Planning Policy Framework.
  5. No dwelling hereby permitted shall be completed above ground floor level until a scheme for the provision of bat roosts has been submitted to and approved in writing by the Local Planning Authority. The submitted scheme shall indicate the plots to be provided with bat roosts, which shall be integrated into the roof or elevations of that dwelling, and their height and location. Any dwelling shown to be host to such a bat roost shall be completed in accordance with the approved scheme. Reason In the interests of enhancing bat breeding habitat in accordance with Policy CP12 of the Local Plan and the National Planning Policy Framework.
  6. No dwelling hereby permitted shall be completed above ground floor level until a scheme for the provision of hedgehog friendly fencing has been submitted to and approved in writing by the Local Planning Authority. The submitted scheme shall indicate the design and height of the fencing and its location around the plots together with the positions of the hedgehog holes to be provided. The scheme shall thereafter be provided in accordance with the approved details and retained for the life of the development. Reason In the interests of enhancing the hedgehog habitat in accordance with Policy CP12 of the Local Plan and the National Planning Policy Framework.
  7. The access to the development shall be completed within the limits of the highway as a vehicle dropped crossing. Reason In the interests of highway safety and in accordance with paragrah 115 of the National Planning Policy Framework.
  8. The proposed car parking, access and turning areas as shown on the approved Proposed Site Plan drawing number JMD 642-10 shall be sustainably drained, hard surfaced in a bound material, lit and marked out prior to the first occupation of the buildings hereby permitted. Thereafter these parking areas shall be retained in accordance with the appoved plans for the lifetime of the development. Reason In the interests of Highway Safety and in accordance with paragrah 115 of the National Planning Policy Framework.
  9. No part of the development hereby approved shall be undertaken above ground level until a noise assessment has been undertaken and submitted to the Local Planning Authority for approval. The assessment shall identify the levels of traffic noise from the adjacent Main Road and include measure for mitigation. Thereafter the approved mitigation measures shall be implemented within the development and retained for the lifetime of the development. Reason In order to minimise the potential for adverse amenity impact from construction activites in the vicinity in accordance with the National Planning Policy Framework.
  10. Prior to the commencement of the development hereby approved, a Construction Environmental Management Plan (CEMP) shall be submitted to and approved in writing by the Local Planning Authority. The approved CEMP shall thereafter be impemented prior to the commencement of the development and implemented thoughout the construction phase. Reason In order to minimise the potential for adverse amenity impact from highways traffic in the vicinity in accordance with the National Planning Policy Framework.
  11. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any Order revoking and re-enacting that Order with or without modification), no development within Part 1 of Schedule 2 to the Order shall be carried out without an express grant of planning permission, from the Local Planning Authority, namely: • The enlargement, improvement or other alteration of the dwellinghouse; • The enlargement of the dwellinghouse consisting of an addition or alteration to its roof; • Any other alteration to the roof of the dwellinghouse; • The erection or construction of a porch outside any external door of the dwelling; • The provision within the curtilage of the dwellinghouse of any building or enclosure, swimming or other pool required for a purpose incidental to the enjoyment of the dwellinghouse as such, or the maintenance, improvement or other alteration of such a building or enclosure; • The provision within the curtilage of the dwellinghouse of a hard surface for any purpose incidental to the enjoyment of the dwellinghouse as such; • The erection or provision within the curtilage of the dwellinghouse of a container for the storage of oil for domestic heating; or • The installation, alteration or replacement of a satellite antenna on the dwellinghouse or within the curtilage of the dwellinghouse. Reason The Local Planning Authority considers that such development would be likely to adversely affect the amenity of neighbouring occupiers and the character of the area. It is considered to be in the public interest to require an application to enable the merits of any proposal to be assessed and to ensure compliance with Local Plan Policy CP3 - Chase Shaping - Design and the NPPF.
  12. Prior to the commencement of any construction or site preparation works including any actions likely to interfere with the biological function of the retained trees and hedges, approved protective fencing shall be erected in the positions shown on the approved Tree & Hedge Protection layout drawing Ref Dwg. No.BALDS033-20-TPP Rev C and read in conjunction with Tree Report Ref:BALDS033-20 Rev C. Within the enclosed area known as the Tree Protection Zone, no work will be permitted without the written consent of the Local Planning Authority. No storage of material, equipment or vehicles will be permitted within this zone. Service routes will not be permitted to cross the Tree Protection Zones unless written consent of the Local Planning Authority is obtained. The Tree Protection Zone will be maintained intact and the vegetation within maintained until the cessation of all construction works or until the Local Planning Authority gives written consent for variation. Reason To ensure the retention and protection of the existing vegetation which makes an important contribution to the visual amenity of the area. In accordance with Local Plan Policies CP3,CP12,CP14 and the National Planning Policy Framework.
  13. The proposed development lies within a coal mining area which may contain unrecorded coal mining related hazards. If any coal mining feature is encountered during development, this should be reported immediately to the Coal Authority on 0345 762 6848.
