  1. In accordance with Paragraph 38 of the National Planning Policy Framework the Local Planning Authority has worked with the applicant in a positive and proactive manner to approve the proposed development, which accords with the Local Plan and the National Planning Policy Framework.
  2. The development to which this permission relates must be begun not later than the expiration of three years beginning with the date on which this permission is granted. Reason To comply with the requirements of Section 91 of the Town & Country Planning Act 1990.
  3. No materials shall be used for the external surfaces of the development other than those specified on the application. Reason In the interests of visual amenity and to ensure compliance with Local Plan Policies CP3, CP15, CP16, RTC3 (where applicable) and the NPPF.
  4. The development hereby permitted shall be carried out in accordance with the following approved plans: Site Location Plan Proposed Site Plan 2023:10:11B Proposed Floor Plans and Elevations 2023:10:12 Reason For the avoidance of doubt and in the interests of proper planning.
  5. Before the development is brought into use, the redundant footway crossing along Eskrett Street must be reinstated with full height kerbs. Reason In the interests of highway safety and to ensure compliance with Local Plan Policy CP3 and the NPPF.
  6. The development hereby permitted shall not be brought into use until the access has been provided in a bound and porous material in accordance with Proposed Site Plan Drawing No. 2023:10:11A and shall thereafter be retained for the lifetime of the development. Reason To ensure suitable access and surface water drainage, in the interests of highway safety and site sustainability.
  7. The proposed development lies within a coal mining area which may contain unrecorded coal mining related hazards. If any coal mining feature is encountered during development, this should be reported immediately to the Coal Authority on 0345 762 6848. Further information is also available on the Coal Authority website at: www.gov.uk/government/organisations/the-coal-authority
  8. The garage shall not be used for any purpose other than the accommodation of private motor vehicles belonging to the occupiers of the dwelling or any other use which is incidental to the enjoyment of the dwelling. Reason To safeguard the amenities of the area and to ensure that the use of the premises does not detract from the enjoyment of their properties by adjoining residents and to ensure compliance with the Local Plan Policy CP3 - Chase Shaping Design and the NPPF.
  9. The construction of the development hereby permitted shall be carried out in full in accordance with the Arboricultural Method Statement and the details contained within the accompanying Foundation Plan 2023:10:20B. Reason To ensure the development is constructed in accordance with the approved foundation plan to safeguard the health and stability of the protected tree.
