  1. The use of the site to provide care and accommodation for two children, with a maximum of two members of staff present on site would form a change of use from a dwelling house within use class C3 of the Use Classes Order to a residential institution within use class C2. However, as a matter of fact and degree, given the nature and quantum of care provided it is considered that a material change of use requiring planning permission would not ensue from the proposal and therefore the proposed change of use would constitute lawful development.
