  1. Reason for Grant of Permission In accordance with paragraph 38 of the National Planning Policy Framework the Local Planning Authority has worked with the applicant in a positive and proactive manner to approve the proposed development, which accords with the Local Plan and the National Planning Policy Framework.
  2. Notes to Developer Coal Authority The proposed development lies within a coal mining area which may contain unrecorded coal mining related hazards. If any coal mining feature is encountered during development, this should be reported immediately to the Coal Authority on 0345 762 6848. Further information is also available on the Coal Authority website at: www.gov.uk/government/organisations/the-coal-authority
  3. Cadent Gas Cadent Gas Ltd own and operate the gas infrastructure within the area of your development. There may be a legal interest (easements and other rights) in the land that restrict activity in proximity to Cadent assets in private land. The applicant must ensure that the proposed works do not infringe on legal rights of access and or restrictive covenants that exist. If buildings or structures are proposed directly above the apparatus the development may only take place following diversion of the apparatus. The applicant should apply online to have apparatus diverted in advance of any works, by visiting www.cadentgas.com/diversions. Prior to carrying out works, including the construction of access points, please register on www.linesearchbeforeudig.co.uk to submit details of the planned works for review, ensuring requirements are adhered to.
  4. Highway Authority The proposed temporary site access works shall require a Highway Works Agreement with Staffordshire County Council. The applicant is requested to contact Staffordshire County Council to secure the Agreement.   5. Staffordshire Police Whilst Staffordshire Police have no objections to the application, the applicant is advised to read full details of the Designing Out Crime Officer's comments on the Citizen Planning Portal. Citizen Portal Planning (agileapplications.co.uk)
  6. The development to which this permission relates must be begun not later than the expiration of three years beginning with the date on which this permission is granted. Reason To comply with the requirements of Section 91 of the Town & Country Planning Act 1990.
  7. No materials shall be used for the external surfaces of the development other than those specified on the application. Reason In the interests of visual amenity and to ensure compliance with Local Plan Policies CP3, CP15, CP16, RTC3 (where applicable) and the NPPF.
  8. The development hereby permitted shall be carried out in accordance with the following approved plans: • Location Plan - CES 2401-01 - Rev P1 • Block Plan (Proposed) - CES 2401-02 - Rev P1 • Proposed Layout and Site Location - CES 2407-03[P1] • Proposed Elevations - CES 2407-05[P1] • Visibility Splays from Temporary Access - SK01 • Small Rigid Exiting Site in Forward Gear - SK02 • Small Rigid Entering Site in Forward Gear - SK03 Reason For the avoidance of doubt and in the interests of proper planning.
  9. Prior to the completion of the development a minimum of one bat box and one bird box as recommended in sections 5.1 and 5.2 of the Bat Emergence Survey report (Elite Ecology, May 2024) shall be erected either on the new build or on suitable trees within the site. Reason To ensure the provision of enhanced roosting opportunities for bats, and nesting opportunities for birds, in accordance with CP12, CP3 and sections 18 0and 186(d) of the NPPF.
  10. Notwithstanding the approved plans, all site demolition and construction activities shall be undertaken strictly in accordance with the approved Demolition Method Statement & Construction Management Plan (15th July 2024) for the duration of the construction programme. Reason In the interests of highway safety and compliance with paragraph 115 of the NPPF.
  11. Before the development is brought into use, the temporary vehicular access crossing on Penk Drive North must be reinstated with full height kerbs and the hedgerow replanted. Reason In the interests of highway safety and compliance with paragraph 115 of the NPPF.
