Planning conditions
  1. The approved landscape works shown on ‘Site Layout’ Dwg. No. NPR.PL01D shall be carried out in the first planting and seeding season following the occupation of any buildings or the completion of the development whichever is the sooner and shall be retained and maintained for a period of five years from completion. Reason In the interest of visual amenity of the area. In accordance with Local Plan Policies CP3, CP12, CP14 and the NPPF.
  2. Reason for Grant of Permission In accordance with paragraph 38 of the National Planning Policy Framework the Local Planning Authority has worked with the applicant in a positive and proactive manner to approve the proposed development, which accords with the Local Plan and the National Planning Policy Framework.
  3. The development to which this permission relates must be begun not later than the expiration of three years beginning with the date on which this permission is granted. Reason To comply with the requirements of Section 91 of the Town & Country Planning Act 1990.
  4. No materials shall be used for the external surfaces of the development other than those specified on the application. Reason In the interests of visual amenity and to ensure compliance with Local Plan Policies CP3, CP15, CP16, RTC3 (where applicable) and the NPPF.
  5. Prior to the commencement of any construction or site preparation works including any actions likely to interfere with the biological function of the retained trees and hedges, approved protective fencing shall be erected in the positions shown on the approved Tree Protection Plan Rev: A - April 2024. Reason To ensure the retention and protection of the existing vegetation which makes an important contribution to the visual amenity of the area. In accordance with Local Plan Policies CP3, CP12, CP14 and the NPPF.
  6. The development hereby permitted shall not be occupied until all 1st floor windows on side elevations indicated on the approved plan are obscure glazed. The windows shall be non-opening unless the parts of the window which can be opened are more than 1.7m above the floor of the room in which the window is installed. Thereafter the windows will be retained and maintained as such for the life of the development. Reason To ensure that the development does not give rise to overlooking of adjoining property injurious to the reasonable privacy of the occupiers and to ensure compliance with Local Plan Policies CP3 Chase Shaping - Design, and the NPPF.
  7. The development hereby permitted shall be carried out in accordance with the following approved plans: - Site Layout Drawing No. NPR.PL.01D - Plot 1 Elevations - NPR.PL.05B - Plot 1 Floorplans - NPF.PL.04B - Plot 2 Elevations - NPR.PL.03A - Plot 2 Floor plans - NPR.PL.02C - Plot 2 Garage Plans/Elevations - NPR.G.01 - Tree Protection Plan Rev:A April 2024 - Preliminary Ecological Appraisal Report No. 20231101CEI_PEA_V1 21 December 2023 Reason For the avoidance of doubt and in the interests of proper planning.
  8. No trees or hedges shown as retained on Tree Protection Plan Rev: A - April 2024, shall be cut down, topped, lopped, uprooted or removed without the prior written permission of the Local Planning Authority nor shall they be wilfully damaged or destroyed. Any trees or hedges which, within a period of 5 years from completion of the development are cut down, topped, lopped or uprooted without permission of the Local Planning Authority or become seriously damaged or diseased or die shall be replaced in the next planting season with similar size and species unless the Local Planning Authority gives written consent to any variation. Reason The existing vegetation makes an important contribution to the visual amenity of the area. In accordance with Local Plan Policies CP3, CP14, CP12 and the NPPF.
  9. The development hereby permitted shall not be brought into use until the parking and turning areas have been provided in accordance with ‘Site Layout‘ Drawing No. NPR.PL.01D and shall thereafter be retained for the lifetime of the development. Reason In the interest of highway safety and compliance with the Councils Parking Standards SPD.
  10. The garage shall not be used for any purpose other than the accommodation of private motor vehicles belonging to the occupiers of the dwelling or any other use which is incidental to the enjoyment of the dwelling. Reason To safeguard the amenities of the area and to ensure that the use of the premises does not detract from the enjoyment of their properties by adjoining residents and to ensure compliance with the Local Plan Policy CP3 - Chase Shaping Design and the NPPF.
  11. The mitigation requirements, compensation requirements and proposed enhancements detailed in Preliminary Ecological Appraisal Report No. 20231101CEI_PEA_V1 21 December 2023, including bat boxes, bird boxes and hedgehog access corridors, shall be implemented prior to occupation of development and thereafter retained for the lifetime of the development. Reason In the interests of conserving habitats and biodiversity in accordance with Policy CP12 of the Local Plan and the NPPF.
  12. Note to Developer Coal Authority The proposed development lies within a coal mining area which may contain unrecorded coal mining related hazards. If any coal mining feature is encountered during development, this should be reported immediately to the Coal Authority on 0345 762 6848.   13. Construction activities and deliveries of construction materials to the site shall not take place outside of the hours of 08:00 hours to 18:00 hours Monday to Friday, 08:00 hours to 13:00 hours on Saturday and at no time on Sundays and Bank Holidays. Reason To ensure that the proposed development does not prejudice the enjoyment by neighbouring occupiers of their properties and to ensure compliance with the Local Plan Policy CP3 - Chase Shaping, Design and the NPPF.
