  3. 3. Materials Prior to the commencement of above ground works (excluding Enabling Works) of any phase details of the materials to be used for the external surfaces of such Phase shall be submitted to and approved by the Local Planning Authority. Reason: In the interests of visual amenity and to ensure compliance with Local Plan Policies CP3, CP15, CP16, RTC3 and the NPPF.
  4. 4. Landscaping Details Prior to the commencement of above ground works (excluding Enabling Works) of any phase, a scheme detailing the external environment to include street furniture and proposed landscaping, to include planting, fencing, walls, surface treatment & construction details of such Phase shall be submitted to and approved by the Local Planning Authority. The details shall be in the form as specified in Annex C of the Supplementary Planning Guidance 'Trees, Landscape and Development'. Reason: In the interest of visual amenity of the area and in accordance with Local Plan Policies CP3, CP12, CP14 and the NPPF.
  5. 5. Tree Protection Prior to the commencement of development, or any actions likely to interfere with the biological function of the retained trees and hedges, details for tree and hedge protection shall be submitted to and approved by the Local Planning Authority. Details shall include the position and construction of all fencing and the care & maintenance of the trees & hedges within. Reason: The existing vegetation makes an important contribution to the visual amenity of the area. In accordance with Local Plan Policies CP3, CP12, CP14 and the NPPF.
  6. 6. Landscape Management The approved landscape works as indicated in the following drawings shall be carried out in the first planting and seeding season following the occupation of the any buildings or the completion of the development whichever is the sooner. Class E(b) Operating hours The opening hours of all Class E(b) (Food and Drink) units shall be limited to one hour before the Class E(a) (Retail) units open and 30 minutes after closing with a delivery sales service only: - Two and a half hours after the units have closed (at 8.30pm) Mondays to Thursdays to 11.00pm; - Three and a half hours after the units have closed (at 8.30pm) on Fridays and Saturdays to 12 midnight; - Four and a half hours after the units have closed (at 6.30pm) on Sundays to 11.00pm; and - Delivery sales service to accord with extended hours on promotional days and public holidays; unless otherwise agreed in writing with the Local Planning Authority Reason: To safeguard the vitality and viability of town centres in accordance with Local Plan Policy CP11 and the NPPF.
  8. 8. CEMP Prior to the commencement of any Enabling Works on any phase, a Construction and Environment Management Plan (CEMP) in relation to those Enabling Works for such phase shall be submitted to and approved in writing by the Local Planning Authority. Prior to the commencement of any development (other than Enabling Works) on any Phase a CEMP for such phase shall be submitted to and approved in writing by the Local Planning Authority. The approved CEMPs shall be adhered to throughout the Enabling Works or construction on any phase, as relevant. The relevant CEMP shall provide for the following: For the CEMP for the Enabling Works: (a) The overall strategy for managing environmental impacts which are likely to arise during the construction phase; an Ecological Assessment detailing proposals for the implementation and management of the proposed development, which addresses the recommendations set out in the Ecological Impact Assessment submitted as part of the Environmental Statement. (b) Detailed management proposals for the buffer zone between the development and Mill Green and Hawks Green Valley Nature Reserve. The management proposals shall be for the entire length of such Phase (including its Enabling Works) and shall include detailed mitigation proposal necessary to offset any potential adverse impacts that may arise from the development on protected species. (c) Management of construction traffic and access/haul routes. (d) Storage of plant and materials used in constructing the development. (e) A scheme for recycling/disposing of waste from demolition and construction works. (f) A signage strategy for construction traffic. (g) provision for surface water management during construction including management of the flows and volumes of run off and pollution mitigation and sedimentation For the CEMP for the construction phases: (h) The parking of site operatives and visitors vehicles. (i) Loading and unloading of plant and materials. (j) Condition surveys and maintenance of all access/haul routes. (k) The erection and maintenance of security hoarding including decorative displays and facilities for public viewing, where appropriate. (l) Wheel cleaning facilities. (m) Measures to control the emission of water pollution, sediment, dust and dirt during construction. (n) Working hours for earthworks & construction 08:00-18:00 Mondays to Fridays, 08:30 – 13:00 Saturdays and no Sunday / Bank Holiday working unless pre-planned and agreed in writing with the Local Planning Authority. (o) Community Liaison Initiatives. (p) No open burning. Reasons: 1: To safeguard the amenity of nearby residents and in the interests of highway safety in accordance with Local Plan Policy CP3 and the NPPF 2. In the interests of protecting and preserving the local wildlife and minimising flooding in accordance with Local Plan Policy CP12
  9. 9. Boundary Noise Limits Noise from fixed plant machinery measured at the boundaries shall not exceed the limits shown in the table below: [See image in decision notice] Reason: To ensure that the proposed development does not prejudice the enjoyment by neighbouring occupiers of their properties and to ensure compliance with the Local Plan Policy CO3 - Chase Shaping - Design and the NPPF.
  10. 10. Outlet Retailing Restriction Notwithstanding the provisions of Class E(a) of the Town and Country Planning (Use Classes) Order 1987 (as amended) (or any Order revoking and re-enacting that Order with or without modification) the development hereby approved shall be operated solely as a Designer Outlet Village in accordance with the following principles of outlet retailing i.e. the sale of discounted comparison goods where at least 90% of the floor space is used for the sale of previous season’s stock, run-offs, over-runs, samples of branded goods, goods produced for subsequently cancelled orders, market testing lines, rejects, seconds, clearance goods, surplus stock and accessories priced at least 30% below the normal price at which similar types of merchandise are or have been offered for sale at their usual place of sale. Reason: Only this specific type of comparison goods retailing and no other form of retailing has been tested by appropriate impact analysis and found to comply with the requirements of paragraph 26 of the NPPF.
  11. 11. Restricted Retail Uses The following uses within Use Class E(a) of the Town and Country Planning (Use Classes) Order 1987 (as amended) (or any Order revoking and re-enacting that Order with or without modification), are not permitted anywhere within the site: (a) as a post office, (b) for the sale of tickets or as a travel agency, (c) for hairdressing, (d) as an opticians or for eye, ear or other medical testing/procedures, (e) for the direction of funerals, (f) for the hiring out of domestic or personal goods or articles, (g) for the washing or cleaning of clothes or fabrics on the premises (h) for the sale of any convenience goods including food, save for a retailer of exclusively confectionary (other than incidental goods), household goods, pets (i) for the sale of furniture, large white goods comprising refrigerators, freezers, dishwashers, washing machines/dryers, cookers, DIY items, carpets, gardening equipment, (j) for the sale of motor vehicles and bicycles, (k) for the sale of books, newspapers and greeting cards, (l) as a charity shop, (m) for the sale of computer games/consoles/CDs or DVDs, (n) for photographic processing, (o) for the sale of toys, (p) as a bank or other financial service other than provision of an ATM. (q) click and collect services from the site for the purpose of distributing full price Reason: To safeguard the vitality and viability of town centres in accordance with Local Plan Policy CP11 and the NPPF.
  12. 12. E(a) and E(b) Floorspace Restriction Notwithstanding the provisions of the Town and Country Planning (Use Classes) Order 1987 (as amended) and / or the Town and Country Planning (General Permitted Development) Order 2015 (as amended) (or any Order revoking or re-enacting or amending that Order with or without modification) the total E(a) and E(b) floorspace hereby permitted under this permission shall not exceed 26,504 sqm and the maximum net sales area for each use shall be: E(a) – up to 24,527.86 sqm E(b) – up to 2,559.4 sqm Reason: To safeguard the vitality and viability of town centres in accordance with Local Plan Policy CP11 and the NPPF.
  13. 13. Permitted Development Restriction Notwithstanding the provisions of the Town and Country Planning (Use Classes) Order 1987 and / or the Town and Country Planning (General Permitted Development) Order 2015 (as amended) (or any Order revoking or re-enacting or amending that Order with or without modification) no E(b) units shall be permitted to change to E(b). Reason: To safeguard the vitality and viability of town centres in accordance with Local Plan Policy CP11 and the NPPF.
  14. 14. Premises Opening Hours The premises shall not be open for business outside the hours of 10.00am to 8.00pm on Mondays to Friday, 9.00am to 8.00pm on Saturdays, 10.00am to 6.00pm on Sundays and 10.00am to 8.00pm on public holidays, except for: - 5 Promotion Days in any calendar year when opening hours can be extended to 9.00am to 10.00pm on Mondays to Fridays; - 2 Promotion Days in any calendar year when opening hours can be extended from 9.00am to 10.00pm on a Saturday; - The summer trading times, the Black Friday Peak, and the Christmas period when opening hours can be extended from 9.00am to 9.00pm on Mondays to Friday, 9.00am to 9.00pm on Saturdays and 10.00am to 6.00pm on Sundays; unless otherwise agreed in writing with the Local Planning Authority. Reason: To ensure that the proposed development does not prejudice the enjoyment by neighbouring occupiers of their properties and to ensure compliance with Local Plan Policy CP3.
  15. 15. Restaurant Extraction Flues Any restaurant use hereby permitted shall not commence until:- (a) details of the extraction and filtration of fumes have been submitted to and approved by the Local Planning Authority, and (b) the approved system has been installed. The system shall hereafter be maintained in an efficient condition for so long as the use is in existence. Reason: To ensure that the proposed development does not prejudice the enjoyment by neighbouring occupiers of their properties and compliance with Local Plan Policy CP3 - Chase Shaping, Design and the NPPF
  16. 16. Noise management The development hereby approved shall be operated in strict accordance with the Noise Management Policy as set out in report reference – Servicing for Mill Green Outlet Village, dated May 2018, and prepared by Development Planning Limited. Reason: In the interests of the amenity of nearby neighbours in accordance with Policy CP3 of the Cannock Chase Local Plan.
  17. 17. Implementation Phasing The development hereby permitted shall only be brought into first use in the sequence set out as follows in line with the submitted phasing plans: - 4670-HMA-XX-00-D-A-00201 P02 Phase 1 Car Park Decks & Car Parks (as consented under CH/24/338, or S73 Amendment 25/0260) - 4670-HMA-XX-00-D-A-00202 P02 Phase 2 Phase 2A Retail - 4670-HMA-XX-00-D-A-00203 P02 Phase 3 Construction of MSCP (as approved in outline under CH/23/0387) - 4670-HMA-XX-00-D-A-00204 P02 Phase 4 Phase 2B Retail. Reason: In the interests of minimising impacts on the public highway and assuring adequate car parking provision for the proportionate demand generated by the phased development, in accordance with Local Plan Policy CP10 and NPPF Para 109 and 115.
  18. 18. Parking Capacity Minimums At no point shall on-site car parking provision in car parks A to G fall below the following amounts for the respective phases of development: - 1, 270 spaces for the operation of Phase 1 - 1, 447 spaces during the construction of Phase 2A retail - 1, 658 spaces during the operation of Phase 2A retail. Reason: In the interests of minimising impacts on the public highway and assuring adequate car parking provision for the proportionate demand generated by the phased development, in accordance with Local Plan Policy CP10 and NPPF Para 109 and 115.
  19. 19. Phase 2B implementation The Phase 2B retail development shall not be commenced until full details of the following have been submitted to and approved in writing by the Local Planning Authority, which shall thereafter be implemented in accordance with the approved details: - Car parking accumulation associated with the Phase 1 and Phase 2A retail developments demonstrating sufficient car parking capacity is available to accommodate demand, especially on Saturdays; - Layout of site including disposition of buildings and provision of adequate parking, turning and servicing areas; - Details of pedestrian routes, cycle routes and public transport infrastructure; - Vehicular visibility splays from the proposed access points within the development; - Surfacing materials; - Full road construction including longitudinal sections and a satisfactory means of draining roads to an acceptable drainage outfall; - HGV swept path analysis of the realigned service road. The parking areas shall thereafter be constructed in accordance with the approved details and be completed prior to first occupation. All car parking spaces shall be surfaced in a bound material, sustainably drained and be clearly delineated and shall thereafter be retained as such for the lifetime of the development. Reason: In the interests of minimising impacts on the public highway and assuring adequate car parking provision for the proportionate demand generated by the phased development, in accordance with Local Plan Policy CP10 and NPPF Para 109 and 115.
  20. 20. No Mezzanines Notwithstanding the provisions of the Town and Country Planning (General Permitted Development (England) Order 2015 (as amended) or Article 44 of the Development Management Procedure Order 2015 (as amended) or any order revoking or re-enacting or amending that order with or without modification, no mezzanine floor or other form of internal floor to create additional floorspace other than that hereby permitted shall be constructed in the hereby permitted Class E(a) (retail) unit without the express consent of the Local Planning Authority. Reason: In the interests of protecting the vitality of Cannock town centre and nearby town and local centres and to ensure compliance with Local Plan Policies CP11 and paragraphs 90-94 of the National Planning Policy Framework.
  21. 21. Acoustic Screens The acoustic screens as detailed in the Mill Green Outlet Village, Cannock Stage 3 report dated 28/07/2017 Revision 01 Acoustics (submitted 22nd May 2018) and as shown on the plan ref: WMDO-HMA-XX-00-DR-A-90561, and the Reflective Sound Screens, as detailed in the documents produced by Hales Sawmills (submitted 23rd July 2018) shall be retained for the lifetime of the development. Reason: In the interests of the amenity of nearby neighbours in accordance with Policy CP3 of the Cannock Chase Local Plan.
  22. 22. Waste Management Strategy No occupation of any phase shall take place until a waste management strategy for such phase has been submitted to and approved in writing by the Local Planning Authority. The strategy shall provide details (including accompanying layout and design plans) of the following: (a) responsible person (including contact details); (b) description of the development (proposed buildings, site area, curtilage, future use, and occupancy); (c) estimation of the type and quantity of wastes anticipated to be produced during occupation of the development; (d) identification of appropriate neighbourhood waste management design features (internal and /or external) and facilities; (e) how adequate space and access provisions for waste management features and facilities will be provided and maintained; (f) neighbourhood waste management facility capacity; (g) how the provision of facilities and design features complement and contribute towards existing waste management infrastructure network and sustainable waste management; and (h) the provision made for ongoing facility management and maintenance, including the collection and use of recycled and composted materials. The development shall be carried out in accordance with the approved strategy. The Waste Management Strategy shall then be carried out in accordance with the approved details. No goods, plant, materials or waste shall be stored or deposited on any part of the site outside a building except in accordance with details laid out within the approved Waste Management Strategy or within an enclosed container, the siting and design of which shall first be submitted to and approved in writing with the Local Planning Authority. Reason: In the interests of proper planning and waste disposal.

Litter Management The scheme for Litter Management, including the provision of litter bins and litter picking, must be carried out in accordance with document West Midlands Designer Outlet Litter Management Strategy (ref CCN001 Litter Management v2) dated January 2021. Reason: In the interests of the amenity of nearby residents and Mill Green Nature Reserve in accordance with Local Plan Policy CP3 .
  24. 24. Car Park Management Regime The development hereby approved shall be operated in accordance with West Midlands Designer Outlet Car Park Management Regime (January 2021). Reason: In the interests of providing adequate parking and safeguarding the amenity of nearby residents. In accordance with Local Plan Policy CP3.
  25. 25. Flood Risk Assessment The development permitted by this planning permission shall only be carried out in accordance with the approved Flood Risk Assessment (FRA) and Drainage Strategy – Robert Bird Group – Phase 2 - Flood Risk Assessment & drainage Strategy, McArthur Glen Designer Outlet West Midlands - Document Number 5018-RBG-XX-ZZ-CV-RP-00002 - Dated 14 February 2024 – Rev P05. The scheme shall be fully implemented and subsequently maintained, in accordance with the timing / phasing arrangements embodied within the scheme, or within any other period as may subsequently be agreed, in writing, by the local planning authority. Reason: To ensure that surface water is appropriately managed on site in accordance with best practice and the development provides betterment by reducing surface water discharge rates and reducing flood risk to communities located downstream of the site; and to ensure that surface water from the newly created hard standing is managed on site and reduces any surface water discharge rates so as to reduce flood risk elsewhere.
  26. Notes to the Developer: 1. Glossary of Terms TERM: "Enabling Works" MEANING: any of the following: i. trial holes or other operations to establish ground conditions or the assessment of contamination ii. site survey work iii. install and/or divert any utility service iv. ecological or nature conservation works associated with the Development v. construction of boundary fencing or hoardings vi. alteration to signage including digital vii. other works below ground viii. any other preparatory works agreed in writing with the Local Planning Authority viii foundation works and any other works up to ground course level ix. or temporary car parking arrangements TERM: "Phase" MEANING: the following: Any part of the development hereby approved as a phase by the Local Planning Authority pursuant to Condition 20 herein. 2. Coal Authority The applicant is referred to comments submitted by the Coal Authority Standing Advice referenced on the Council’s planning website which should be considered. 3. Staffordshire Police The applicant is referred to comments submitted by Staffordshire Police published on the Council’s planning website which should be considered.
  27. In accordance with paragraph 38 of the National Planning Policy Framework the Local Planning Authority has worked with the applicant in a positive and proactive manner to approve the proposed development, which accords with the Local Plan and the National Planning Policy Framework.
