The application seeks a Non Material Amendment to 21/0197 in order to vary the approved plans via the insertion of a plan under Condition 41. Further, it is proposed to add the following condition to planning permission CH/21/0197 to provide the Council with greater control: “The upper floors of Building 6 of Phase I shall be restricted to non-trading uses only.” It is understood that whilst the total amount of Net Sales Area (‘NSA’) in Phase I has been built and extends to 18,313 sq m, only 17,375 sq m is in use for retail sales now or indeed intended to be in the future. This amounts to 938 sq m of NSA which is instead currently in use as managed space at first floor level. It is therefore the intention to convert this area formally to storage and transfer the unused NSA into the Phase II retail area (via the ‘Slot-In’ Application which has been submitted alongside this application). To control the amount of trading floorspace within Phase I, the Phase I First Floor Plan (Ref: A-00-110 Rev: J) is to be replaced by the Phase I First Floor Plan (Ref: A-00-110 Rev: J1) (prepared by Holder Mathias Architects) with reference to retail at first floor level removed. Both plans have been submitted in support of this application. An extract of Block 6 is shown below: Given that the ‘Slot-In’ application involves the transfer of the 938 sq m of NSA from Phase I to Phase II, the proposed non-material amendment will limit the trading floorspace of Phase I so that the overall amount of trading floorspace of McArthurGlen Designer Outlet West Midlands (‘MGDOWM’) (as a whole – Phase I and Phase II) is consistent with the amount (26,504 sq m) controlled by Condition 33 of planning permission ref:CH/21/0197. In the context of the merits of the original application these changes do not prejudice wider considerations around retail impacts or similar and effectively secure the same restrictions as consented. Accordingly the Non Material Amendment is approved and condition 41 is formally amended as stated above along with the addition of a new condition stating the following which is also added to decision 21/0197: “The upper floors of Building 6 of Phase I shall be restricted to non-trading uses only.”
