Discharge of Conditions - Full Approval
Planning conditions
  1. This application seeks the discharge of Condition 18b in respect of the access road and associated works that serves the ATS. The area covered by this application is shown on the Site Location Plan within the Appendix Site Maps & Plans of the submitted Verification Report. The site boundary shown accords with the reserved matters approvals for the ATS access road granted approval July 2024 under references 23/01012/REMM and CH/23/0312. In relation to the ATS access road, Condition 18 of the outline planning permission was discharged by LDC on 11 October 2024 and CCDC on 4 September 2024 under applications 19/00753/DSCH21 and CH/19/201/P respectively. Notwithstanding this, it is understood that Condition 18b will not be discharged in full until any necessary construction phase measures have been completed and approved via a Condition 18b submission. The Verification Report (Oakshire Environmental, 23 January 2026) is submitted in support of this application. The objectives of the Verification Report were to: •Determine the efficacy of remediation work carried out at the site; and •Assess the requirement for further investigations, remediation or mitigation measures. The report outlines previous investigations and the remediation strategy and implementation. Verification includes a review of documents and supporting evidence collected during implementation, with supporting information appended including Materials Management, Laboratory Testing and Reports, Waste Transfer Notes and Environmental Incidents. Based on the review of verification evidence, it is concluded that the remediation work has been carried as recommended and has sufficiently mitigated the risk to future site users from potentially contaminated soils beneath the carriageways and footways of the ATS access road. The Canal and Rivers Trust, Environment Agency and the Council’s Environmental Protection team were consulted as part of the application process. No objections to the partial discharge of Condition 18B for this respective phase of the development were received. As such Officers are satisfied the application can be approved with partial discharge approval as requested.
