Viewfield Court Limited seek to modify the planning obligations contained within Planning permission reference 14/00282/FULL for subjects known formerly as Viewfield Hotel and Lodge, and now known as Viewfield Court, being registered in the Land Register of Scotland under title number ANG25864, which planning permission was secured by an Agreement under Section 75 of the Town and Country Planning (Scotland) Act 1997 between Angus Council, and Viewfield Court Limited dated 11th and 16th March 2016 and registered in Land Register of Scotland under title number ANG25864 (hereinafter referred to as "the Agreement"). The modification is required to allow for the Affordable Housing Provision to now be made by way of a method of delivery agreed in a Delivery Package rather than by payment of a Commuted Sum as provided in the Agreement. The required modifications are contained in attached annexation subscribed as relative hereto.
