The application is to modify clauses 1, 5, 6 and 7 of the planning obligations relating to planning permissions 09/00695/OUT and 13/00086/FULM affecting land at Omachie, Newbigging, Angus secured by an agreement under section 75 of the Town and Country Planning (Scotland) Act 1997 ("the Act") between Angus Council of County Buildings, Market Street, Forfar DD8 3LG, Alistair Graham Milne Forbes and Mrs Cynthia Bartow or Forbes residing together at Whitecroft, Drumsturdy Road Dundee as partners of and trustees for the Firm of A G M Forbes of Whitecroft, Drumsturdy Road Dundee with the consent of Michael Bartow Forbes residing at Newbigging by Dundee and Omachie Farms Limited a company formerly incorporated under the Companies Acts (Company Number SC156595) and having its registered office at Third Floor, Turnberry House, 175 West George Street, Glasgow, G2 2LB, Michael Bartow Forbes and Gail Forbes residing together at Newbigging by Dundee as partners of and trustees for the Firm of Forbes of Kingennie of Newbigging by Dundee, Michael Bartow Forbes and Gail Forbes residing together at Newbigging by Dundee and M B Forbes as partners of and trustees for the Firm of M B Forbes & Company of Omachie, Newbigging by Dundee and Shank of Omachie Limited a company incorporated under the Companies Acts (Company Number SC405922) and having its registered office at Princes Exchange, 1 Earl Grey Street, Edinburgh EH3 9EE dated 28 December 2011, 4 January 2012, and 5 January 2012 and registered in the Division of the General Register of Sasines applicable to the County of Angus on 30 January 2012 and also in the Land Register of Scotland under Title Numbers ANG50210 and ANG51110 (hereinafter referred to as "the Agreement")
