McCallan Homes Limited Seek to Modify the Planning Obligations Contained within Planning Permission Reference 08/01087/FUL for subjects at Former Inverpark House Hotel, Thirty Three Bank Street, Arbroath, being Land Registered in the Land Register of Scotland Under Title Number ANG32467, which Planning Permission was Secured by an Agreement Under Section 75 of the Town and Country Planning (Scotland) Act 1997 Between Angus Council, and Jack William Rase and Ann Marie Rase Registered in Land Register of Scotland Under Title Number ANG32467 (hereinafter referred to as 'The Agreement'). The Modification is Required to Allow for the Affordable Housing Provision to now be made by way of a Commuted Sum for Two Units rather than Providing Two Affordable Housing Units Within the Development as provided in the Agreement. Modification is also required to Reflect Change of Ownership of the Planning Subjects. The required Modifications are contained in attached annexation subscribed as relative hereto.
