Pert Bruce Construction Limited, seek to modify the planning obligations contained within Planning Permission Reference 11/00359/FULL for subjects between Lower Balmain Street and Hill Place, Montrose, being land registered in the Land Register of Scotland under title numbers ANG32598, ANG30661 and ANG36070, which planning permission was secured by an Agreement under Section 75 of the Town and Country Planning (Scotland) Act 1997 between Angus Council, James Pert Retirement and Death Benefit Scheme and Pert Bruce Construction Limited (hereinafter referred to as "the Agreement") registered in the Land Register of Scotland under title numbers ANG32598, ANG30661 and ANG36070. The Modification is required to allow for the provision of Ten (10) Affordable Units for Social rent, rather than Three (3) Discounted Value Affordable Units as provided in the Agreement. The required modifications are contained in attached annexation subscribed as relative hereto.
