Council planning record

Cedar T3: Crown lift northern canopy over car park removing the first branch at 3 metres at the stem (TPO 09S146 G1) Lime T15: Through a combination of crown reduction and crown lifting cut the canopy to the boundary for a height of 5 metres from the ground. (TPO 09S21 T1) Lime T16: Through a combination of crown reduction and crown lifting cut the canopy to the boundary for a height of 5 metres from the ground. (TPO 09S21 T2) Reasons for Work T3: to allow the use of the car park and prevent damage to the tree and the tree's branches through use. The pruning is not considered to be detrimental to tree physiology. The pruning has no impact on visual amenity as the location of pruning is not visible from public vantage points. The impact is likely to be negligible, it is appropriate to grant consent even if the authority believes there is no particular arboricultural need for the work. T15 and T16: These trees over hang the site boundary and constitute a nuisance. The causes of the nuisance may be physical (e.g. tree roots growing across land or an oil leak causing soil contamination), development works or even small acts such as hanging a sign over a neighbour's property. The trees cause a nuisance by the fact that they overhang the boundary. They interfere with the comfortable and convenient enjoyment of the land. Regulation 14 of TOWN AND COUNTRY PLANNING, ENGLAND The Town and Country Planning (Tree Preservation)(England)Regulations 2012 allows for the abatement of a nuisance in so far as may be necessary. The visual and physiological impact is negligible. It is appropriate to grant consent even if the authority believes there is no particular arboricultural need for the work. The trees constitute a nuisance.
