Reason: To ensure that animal and plant species and habitats are adequately protected, and to protect and enhance the character and appearance of the site and its setting within the Pembrokeshire Coast National Park and to accord with policy: Local Development Plan 2 – Policies 1 (National Park Purposes and Duty), 8 (Special Qualities), 10 (sites and species of European importance), 11 (Nationally protected sites and species) and 14 (Conservation of the Pembrokeshire Coast National Park). Section 6 of PPW edition 12.
Informative Notes Pollution Control All works at the site must be carried out in accordance with GPP5, Works and maintenance in or near water and GPP6 Working at construction and demolition sites which are available on the following website: gpp-5-works-and-maintenance-in-or-near-water.pdf (netregs.org.uk) and gpp6-working-on-construction-and-demolition-sites.pdf (netregs.org.uk). Badgers Badgers and their setts are protected under The Protection of Badgers Act 1992. It is an offence to wilfully kill, injure, take, possess or cruelly ill-treat a badger, or to attempt to do so; or to intentionally or recklessly interfere with a badger sett which includes damaging or destroying a sett, obstructing access to a sett, or to disturb a badger occupying a sett. The following activities require a Badger licence from NRW: • Using very heavy machinery within 30 metres of any entrance to an active sett. • Using lighter machinery (particularly for any digging operation) within 20 metres. • Light work such as hand digging or scrub clearance within 10 metres. Nesting Birds Under the Section 1 of the Wildlife and Countryside Act 1981 (as amended) it is an offence to kill or injure any wild bird, take, damage or destroy the nest of any wild bird while that nest is in use or being built. Therefore, any works affecting nesting birds on site must be done outside the nesting season, which is recognised to be from March to August inclusive, unless it can be demonstrated by a suitably qualified ecologist that nesting birds are absent through a Nesting Bird Check. It should be noted that birds may still be nesting outside this season, therefore care should be taken to ensure that no nesting birds are affected. Green Infrastructure In order to comply with PPW12 and the Environment (Wales) Act 2016, the following has been suggested: • The creation of a rain garden including native vegetation species shown in drawing P02a. • The planting of one additional tree either Rowan (Sorbus aucuparia) or Crab apple (Malus sylvestris). Either would be acceptable. • Soft-landscaping including additional pollinator friendly planting • Hedgerow reinforcement where necessary following a species mix of 50% blackthorn (Prunus spinosa), 10% honeysuckle (Lonicera periclymenum), and 50% hawthorn (Crataegus monogyna) Species should be selected from the native trees and shrubs list, or the native wildflowers list. Protected Species It is recommended that the applicant be informed that all British bat species are European Protected Species by virtue of their listing under Annex IV of EC Directive 92/43/EEC (The Habitats Directive). This Directive has been transposed into British Law under the Conservation of Habitats and Species Regulations 2017. British bats are also protected under Schedule 5 of the Wildlife and Countryside Act (1981) (as amended). It is a criminal offence to intentionally, or recklessly disturb, harm, or kill bats or to destroy a bat 'roost', even if only occasionally used. If bats are encountered on site works should stop immediately an NRW should be contacted (Natural Resources Wales, - General Enquiries: enquiries@naturalresourceswales.gov.uk or 0300 065 3000 Mon-Fri, 8am - 6pm) a licence may then need to be applied for from NRW. Licences are not automatically granted by virtue of a valid planning consent, and it may be possible that the necessary licence application may be refused.
