  1. Having regard to the duty placed on local planning authorities not to entertain any application for planning permission unless it is accompanied by an ownership certificate signed by or on behalf of the applicants, the Authority has declined to determine this application. The application as submitted does not meet validation requirements as it does not meet the relevant statutory tests as set out in section 62 (4A) of the Town and Country Planning Act 1990 (inserted by the Growth and Infrastructure Act) and article 11(3)(c) of the Town and Country Planning (Development Management Procedure) (England) (Order) 2015. This is because the correct notice has not been served on all relevant landowners in this case (as the application has been submitted under Certificate A and the red line includes land which is not within the applicant’s control / ownership).
