The proposed development would not be limited in scale and would also give rise to damage to the special qualities of the New Forest contrary to the requirements of Policies SP46 and DP45 of the adopted New Forest National Park Local Plan (2019). Furthermore, the proposed development would not seek to further the statutory purposes of the National Park, contrary to the requirements of Section 245 of the Levelling Up and Regeneration Act 2023 which amended Section 11A of the National Park and Access to the Countryside Act 1949.
The proposal would fail to enhance the landscape of the New Forest through high quality design and would not respond appropriately to the local distinctiveness of the area. It would also not be contextually appropriate or sympathetic in terms of scale, appearance, would erode the Park’s local character, and would result in suburbanising effects and light pollution. For these reasons the proposed development would be contrary to Policies DP2, DP18, SP1, SP7, SP15, SP17 of the adopted New Forest National Park Local Plan (2019) along with guidance contained within the Design Guide SPD.
Insufficient evidence has been submitted to quantify, assess and provide offset for impacts upon the New Forest Special Protection Area (SPA), Special Area of Conservation (SAC), Site of Special Scientific Interest (SSSI) and Ramsar designations. The proposed development is therefore contrary to Policies SP5 and SP6 of the adopted New Forest National Park Local Plan (2019) along with paragraphs 193 and 194 of the National Planning Policy Framework and the legal requirements of the Habitats Regulations.
Having regard to the amount of development proposed and the absence of any robust ecological evidence relating to the existing site, there is insufficient information to enable the Authority to conclude that the proposal would be exempt from mandatory Biodiversity Net Gain under Regulation 4(1) of the Biodiversity Gain Requirements (Exemptions) Regulations 2024. Therefore, the standard biodiversity condition cannot be confidently discharged and (in adopting a precautionary approach) it is concluded that the proposal would be contrary to Schedule 7A of the Town and Country Planning Act and Policy SP6 of the adopted New Forest National Park Local Plan (2019)
The Authority has considered the application in relation to its adopted Local Plan, the National Planning Policy Framework and any other relevant material planning consideration and has concluded that the application proposes such an inappropriate form of development that no amendments could be recommended to enable planning permission to be granted.
