Decision & conditions

Certificate of Lawfulness Granted

Planning conditions
  1. The evidence provided establishes on the balance of probability that all of the land the subject of this application has been used for residential purposes in association with the use of the building known as Ridding Bay including its lodge, for a period in excess of 10 years and is therefore immune from enforcement action and as such the use is lawful.
  2. INFORMATIVE - NATURE OF THIS DECISION This decision does not designate the application site, or any part thereof as the curtilage of a dwellinghouse. Curtilage is a phyiscal and legal decription of land. It is not a planning land use category that can be formally granted or extended by permission. Householder permitted development rights, as set out within Schedule 2, Part 1 of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended), apply strictly to development within the established, functional curtilage of a dwellinghouse. Consequently, the land subject to this decision does not benefit from these permitted development rights. Any subsequent operational development or outbuildings on this land may require a separate application for full planning permission. If you have questions about the above please contact us.
